I recently travelled from India to Germany. I am a home maker and do not have a job. I am living as a dependent in Germany. I got married last month and came to Germany with my husband. Along with me I carried few necessary gold items which a newly married woman has to wear as per Hindu tradition.
Unfortunately neither me nor my husband was aware of the permissible gold and we didnt declare gold.
We were questioned by the custom police and we answered and gave all the necessary documents for the gold which we were carrying. We also paid a fine of 730 Euros.
Now we got a letter stating Criminal/Tax crime proceeding is initiated.
How can we drop this criminal charge? What should I reply ?
you should actually hire a lawyer immediately, who will first look at the files and only then examine and discuss how to proceed. That's my most important and first piece of advice, which of course also costs money and can be expensive, lawyer's fees.
Otherwise, you can make it clear in your own letter that you had no intention of tax evasion.
Because:
The gold jewelry would have been worn traditionally and you would not have been aware of it. Point out that you have already paid the subsequent taxation (750 euros subsequent taxation, no fine), you are sorry for the incident and that the procedure should be discontinued.
