Hi, I hope it's ok that I ask this question in English. In 2011 I was arrested for theft. I had stolen clothes from a shopping mall by cutting off the security alarm with a scissors. It was clothes for a value of around €1,000. It was the first time arrested and I was over 18. I did not have to go to court but ended up having to pay a fine of around €1,200. This happened in Berlin.

I now wonder for how long this will show up in my police records? It's been 4 years now and it is a big problem when I apply for jobs. I want to know when this will no longer show up when the company does their background checks.

thanks for your inquiry, which I`d like to answer based on your information:

As you payed the fine in 2011 (Geldstrafe), there should be no entry in the police records (Bundeszentralregister). According to § 34 Abs. 1 Nr. 1 BZRG the entry gets deleted after 3 years if you weren`t fined more than 90 day rates (Tagessätze). In case the lawsuit was suspended after paying the € 1200 as an obligation (§ 153a StPO – Einstellung gegen Auflage) there was no entry at all.

Because I don`t know the exact basis of the fine, I can`t judge your question in a concluding way (I can`t exclude the possibility of more than 90 day rates).

Hi Michael,

Thank you for your answer. The lawsuit showed up in a background search when I applied for a job last year (2015 - so more than 3 years later). I can't remember if it was more than 90 day rates but if it was, would that show up in the police register for longer than 3 years?

I hoped that I wouldn't have to declare the crime before a job background check when it is no longer in the police register.

Dear questioner,

if there are more than 90 day rates, according to § 34 Abs. 1 Nr. 3 BZRG the entry shows up in the register for 5 years. The basis of the fine has to get checked, before there can be told, if the entry is an error.
